INTRODUCTION

Welcome to our website. These are our Terms & Conditions, which can be split into two sections. The first covers aspects of our business as independent opticians, based in Hay-on-Wye, and relates to the services we offer to clients and customers at our Practice. The second section is specific to your use of this website.

In both, the term ‘Jackson and Gill Opticians Limited’ or ‘Jackson and Gill’, ‘us’ or ‘we’ refers to the owner of the website whose registered office is Backfold, Castle Street, Hay-on-Wye, Hereford HR3 5EQ. The term ‘you’ refers to the user or viewer of our Services and/or website.

If you avail yourself of the Services we offer through the Practice, you may find that the paragraphs below will include information that you could find useful, including those that relate to certain legal obligations that may arise as a consequence of accessing our services.

In addition, if you continue to browse and use this website, you are agreeing to comply with and be bound by certain Terms & Conditions relating to this website which, together with our Privacy Policy, govern Jackson and Gill Opticians’ relationship with you regarding the use and content of this website. They may also, where applicable, have bearing upon our relationship with you as a patient or customer at the Practice.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms and Conditions, which apply to all users of this site, including without limitation, users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms carefully before accessing or using our website. By continuing, you agree to be bound by these Terms, and if they are considered an offer, acceptance is expressly limited to these Terms.

If you disagree with any part of these Terms and Conditions of Use or Service, please do not use our website or any of our Services.


The Practice

1. Eye Examinations

Under the terms of the Opticians Act 1989, only registered medical practitioners or optometrists are permitted to test a person’s sight. Our charge for an extended eye examination is £90. Some customers may be eligible under the General Ophthalmic Services (GOS) for an NHS-funded sight test, in which case there is no charge for a standard eye examination – see next section.

The assessment itself typically includes:

  • The recording of the patient’s name, address, date of birth, and reason for the visit.
  • A verbal investigation into the patient’s medical history, including any history of ocular or general health that may be relevant to the eyes.
  • Questions about the patient’s visual needs, such as requirements for driving, recreation, computer work or industrial employment.
  • Noting the patient’s previous prescription and the date of their last eye exam

The physical eye examination will include some or all of the following procedures:

  • Vision Test: Our optometrists will use a letter chart and different strengths of trial lenses, usually using a phoropter to determine the correct prescription for the patients’ eyes, in order to achieve the best-possible vision for distance, intermediate and near work.
  • Eye Health Screening: Our optometrists will look for any abnormal eye conditions such as cataracts, glaucoma, and macular degeneration, from the front to the back of the eye. They may use a slit lamp, ophthalmoscope, Ocular Coherence Tonometer (OCT) and Optos wide field photography to achieve a better understanding of eye-health and efficiency.
  • Eye Pressure Measurement: A Tonometer will be used to measure the pressure of the fluid inside the eye, known as the Intraocular Pressure. It is a vital test for Glaucoma.
  • Pupil Reflex Assessment: This is to check the pupil reflexes and involves shining a light obliquely into the eye. The optometrist will record how the pupils respond to the light and note any differences between the two eyes.
  • Visual Field Assessment: The optometrist may carry out a Visual Fields Test (also known as Perimetry) to assess peripheral vision, especially if there is a risk of Glaucoma.
  • Depth Perception Test: The application of a Stereopsis Test will assess depth perception.

An extended eye examination usually takes about 45 minutes. You can book an eye examination by email, by telephone, or by calling in to see us during opening times.

We recommend that patients have an eye examination every two years. If we determine that a person’s eye health warrants it, we may advise a yearly or six-monthly check-up. There is no age limitation for an eye examination. Young people under the age of 16 years must be accompanied by a parent or guardian.


2. Eye Examinations under the NHS

We are able to offer NHS-funded eye examinations, provided the patient meets a number of simple requirements, largely based upon age and health:

  • Age. To be entitled to a free eye test based upon age, the patient must be under 16 years, aged between 16 and 18 and in full-time education, or aged 60 years or more.
  • Health. Patients are eligible for a free NHS eye test if they have been diagnosed with diabetes or glaucoma, are registered blind or partially sighted, or have a Family History of Glaucoma.
  • Benefits. Those claiming certain Benefits may be entitled to a free eye test, including:
    Income Support
    Income Based Job Seekers Allowance
    Income Based Employment & Support Allowance
    Universal Credit (and meet the criteria)
    Working Families Tax Credit
    Disabled Persons Tax Credit

Those eligible and meeting these Terms are entitled to an NHS-funded eye test every two years. However, we may recommend more frequent eye tests if your eye health warrants it, or there is a family history of eye-related issues, especially in later years.

Some patients may be eligible for an NHS Optical Voucher if they need especially complex lenses, such as lenses that are -10 or +10 dioptres or more. The voucher provides money off the cost of purchasing new lenses.

Welsh Eye Care Scheme (WECS)
Those living in Wales or registered with a Welsh G.P. may be eligible for an NHS-funded eye health examination under the Welsh Eye Care Scheme. This service aims to provide a better level of eye healthcare than visiting your GP practice, and our optometrists are trained to deal with a range of minor eye health problems, such as a red eye, swollen lids, eye infections, painful eyes or unusual symptoms such as flashes of light or floaters in your vision.


3. Love Your Glasses

The Consumer Rights Act of 2015 offers consumers certain rights when purchasing items or services from an optician. The act states that refunds can be issued up to and including 14 days of purchase, and in the same form as the original payment (see Refunds). However, here at Jackson and Gill Opticians, we believe that customers should be delighted with their new spectacles, and that they should be comfortable to wear. We know that it may not always be possible to get the comfort right during a first fitting, so clients can call in to see us at any time to have their glasses refitted by our expert staff.

If for whatever reason clients are not happy with their purchase of new spectacles, we will replace them. Furthermore, for the lifetime of the spectacles, customers are also invited to return to the Practice to have their glasses checked, re-fitted and cleaned. We will also carry out minor repairs, such as tightening hinge screws, adjusting or replacing bridge pads, and checking lenses, at no extra charge.

This offer of free servicing and minor repairs does not include replacing damaged, cracked or scratched lenses, or fixing frames or sides that have been bent, broken or snapped, as this constitutes physical damage which would require replacement rather than servicing.

These Terms do not affect your statutory consumer rights.


4. Contact Lenses

We welcome enquiries from those considering Contact Lenses for the first time, or from existing wearers of contact lenses.

As part of an initial consultation, our trained optometrist will discuss the lifestyle, vision, eye health and expectations of the customer in order to determine which of various types of contact lenses may be most suitable. The customer must have a up-to-date spectacle prescription. Subsequently, the customer will be offered a complimentary pair of lenses, to try for a short period of time. As part of the process the customer will be given instruction on how to insert, remove, and care for their lenses.

On returning, our optometrist will check the fit of the lenses and make sure they are comfortable and not causing damaging or discomfort. If the trial has gone well, the customer will be invited to purchase a further supply of lenses.


5. Jackson and Gill EyeCare Plan

We offer clients the benefits of our bespoke EyeCare Plan, designed to spread the cost of professional fees and when purchasing prescription spectacles, contact lenses and prescription frames.

Contact Lens Wearers
For a regular direct debit payment of £12.50 per month, contact lens users can cover the cost of all appointments at the practice, including eye examinations, scans, photographs, and contact lens consultations. This also entitles the subscriber to a discount off the cost of all contact lenses purchased from the practice. If paying for contact lenses by direct debit, this additional fee would be added to the professional fee. Please ask for details for your particular type of contact lenses.

Spectacle Wearers
For a regular direct debit payment of £11.50 per month, spectacle users can cover the cost of all appointments at the practice, including eye examinations, scans and photographs. This also entitles subscribers to a special 30% discount off the full cost of prescription spectacles.

Prescription Spectacles
Any client purchasing spectacles, whether they already pay for their professional fees by direct debit or not, may pay for their spectacles by direct debit, with up to 11 monthly installments. An initial deposit of 30% will be required.

6. Delivery

Products ordered from us at the practice may either be collected from us by you, in person or, by prior arrangement, can be delivered to the address given when the order was placed, not necessarily the address we hold on your optical records.

  • We cannot be liable for any loss or damage due to an incorrect delivery address supplied by you.
  • We cannot guarantee delivery times for items ordered through our Practice. Orders for certain types of lenses, for example, may take longer to fulfil than others. We will endeavour to deliver your lenses or spectacles in a timely manner and will do our utmost to advise you should we foresee a delay.
  • Orders for multiple items may be split into two or more deliveries.
  • A minimum of a five-day period of grace will apply before replacements are requested on orders which do not arrive after notification of despatch, either by us, with us, or from our suppliers.
  • All products remain our property until full payment is received.

7. Returns and Refunds

These Terms & Conditions relate to items supplied to you remotely, by courier or postal delivery.

You may Return any unwanted products to us for a full refund by notifying us within 14 days after delivery. Any contact lens or solution box must be unopened, unmarked and in its original packaging. If your order was delivered in multiple shipments, the 14 day deadline applies from delivery of the last shipment. We cannot reimburse you for the cost of the return and the return is at your own risk.

If you are returning faulty or damaged products, please include a note stating the nature of the fault and whether you would like a replacement or refund. Contact Lenses which have been removed from their original packaging must be returned in a lens case with some suitable solution to allow us to analyse the lens for faults.

Returns should be either delivered to, or sent to: Backfold, Castle Street, Hay-on-Wye, Hereford HR3 5EQ, with details of your order number, name and the address used with the order.

Refunds will be made using the same payment method as the original order. Goods must be received within 14 days of notifying us that you wish to return them, or other evidence of posting provided. The refund may be withheld until the goods are received or evidence of posting is provided.
